What are the Model’s rights to the images?
Just the same in all creative industries the model does not have copyrights to any images produced. This means that while you have your own CD of images you cannot use the images for financial gain or for editorial use. If you would like to use the images for these purposes then written permission is required from the copyright owner. I do of course let models and clients use the images for their portfolios, personal printing and submission to modelling agencies.
So what can are the Photographer’s rights to the images?
The photographer holds full copyrights for all images that are taken, just the same as a writer retains copyright of a song even if someone else is singing it. The copyright system means that because the photographer owns the image, they are able to use the image for all editorial, commercial and personal uses.
Do I have to sign a model release for TFP/TFCD shoots?
The majority of professional photographers require model releases to be signed for all shoots. On our shoot I would request you sign the release as it protects us both. If however you have any queries about what the legal mumbo jumbo means, I will be glad to explain. In these situations the photographer can always use images for editorial uses, but in TFP shoots the model release can be used to tell both parties what they can and can not do with the images, stock image libraries for example.
